FHE’s Meal Tracker Terms of Use

These Terms of Use (“Terms”) govern your use of the FHE’s Meal Tracker mobile application and related services (“FHE” or the “Service”). The Service is operated by Gabriel Yap Beng Chih in Singapore (“we”, “us”, or “our”).

By creating an account, selecting Agree and continue, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and account security

You must be at least 18 years old to create an account or use FHE. By creating an account, you confirm that you are at least 18.

You must provide accurate account information, protect your password and device, and promptly tell us if you believe your account has been compromised. You are responsible for activity performed through your account unless applicable law provides otherwise.

2. What FHE provides

FHE helps users record meals, estimate nutrition from photographs, track goals and progress, and receive general informational coaching. Features and availability may differ by plan, device, region, app version, and service availability.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use FHE for your own lawful purposes.

3. Important nutrition and health limitations

FHE’s photograph analysis, nutrition values, targets, coaching, and other AI-generated content are estimates. They can be incomplete, outdated, or wrong. FHE is intended only for general well-being purposes and to encourage or maintain a healthy lifestyle. It is not intended for any medical purpose and is not a medical device. FHE does not provide medical advice, diagnosis, monitoring, management, treatment, emergency assistance, or medication recommendations.

You must review information before relying on it. Do not use FHE to determine whether food is safe to eat: it cannot reliably identify ingredients, allergens, contamination, or food safety risks. Do not use FHE as a substitute for a qualified healthcare professional, particularly if you are pregnant, under medical care, managing allergies or an eating disorder, or have a condition affected by diet. Seek appropriate professional or emergency help when needed.

4. Photographs, notes, and other user content

You retain ownership of the photographs, notes, corrections, profile information, and other content you submit (“User Content”). You give us a limited, non-exclusive licence to host, copy, process, transmit, resize, and display User Content only as needed to provide, secure, troubleshoot, and support the Service in accordance with the Privacy Policy. This licence ends when the relevant User Content is deleted from our active systems, subject to lawful retention and temporary provider backups.

You confirm that you have the necessary rights and permissions for User Content you submit. Do not submit illegal content, content that infringes another person’s rights, or another person’s sensitive information without authority.

5. AI features

Cloud AI features may send selected User Content to the AI provider described in the Privacy Policy after the required consent is enabled. AI output is generated probabilistically and is not guaranteed to identify a dish, portion, ingredient, allergen, or nutrition value correctly.

You must not attempt to bypass safety controls, misuse the Service, extract confidential system instructions, automate abusive requests, or use output to harm yourself or another person.

6. Subscriptions and payments

FHE may offer free and auto-renewing paid plans. The features, duration, and localized price shown in the app and Apple’s purchase sheet apply when you subscribe.

  • Payment is charged to your Apple Account when you confirm a purchase.
  • A subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period.
  • Apple may charge the renewal within 24 hours before the current period ends.
  • You can manage or cancel a subscription in your Apple Account subscription settings.
  • Use Restore purchases in FHE to restore an eligible purchase linked to your Apple Account.
  • Refunds and billing disputes are handled by Apple under its applicable policies.

Deleting your FHE account does not cancel an Apple subscription. Cancel the subscription with Apple first if you do not want future renewal charges.

The Apple Media Services Terms and Conditions and Apple’s standard Licensed Application End User License Agreement also apply where relevant. If these Terms conflict with non-waivable Apple terms, the applicable Apple terms control to that extent.

7. Acceptable use

You may not:

  • Break the law or violate another person’s rights using FHE.
  • Upload malware or disrupt, overload, probe, or bypass the Service’s security.
  • Reverse engineer the Service except where applicable law expressly permits it.
  • Use another person’s account without permission.
  • Resell, sublicense, scrape, or commercially exploit the Service without written permission.
  • Misrepresent AI estimates as verified medical or laboratory results.

We may restrict or suspend access where reasonably necessary to protect users, comply with law, investigate misuse, or maintain the Service.

8. Third-party services

FHE relies on third-party services including Apple, Supabase, Render, OpenAI, Expo, and RevenueCat. Their terms and privacy practices may also apply to their services. We are not responsible for third-party services beyond what applicable law requires.

9. Availability and changes

We aim to provide a reliable Service but do not promise uninterrupted or error-free availability. We may change, suspend, or discontinue features, introduce plan limits, or update these Terms. If a change is material, we will provide notice where reasonably practicable or legally required.

10. Intellectual property

FHE, its software, design, branding, and content supplied by us are owned by or licensed to us and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.

11. Disclaimer and limitation of liability

To the fullest extent permitted by law, the Service is provided on an “as available” basis without warranties that it will be uninterrupted, error-free, medically suitable, or completely accurate.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive loss arising from use of or inability to use FHE, reliance on an estimate, or a third-party service. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.

12. Ending your account

You may initiate permanent account deletion inside Settings → Profile → Account & privacy. Deletion covers the FHE account and associated application data as described in the Privacy Policy. Some limited information may be retained where required by law or necessary for legal claims.

We may terminate or restrict an account for serious or repeated breach of these Terms, unlawful use, security risk, or where required by law. Provisions that by their nature should survive termination will remain effective.

13. Governing law

These Terms are governed by the laws of Singapore, without limiting any mandatory consumer protection that applies where you live. Courts with lawful jurisdiction may hear disputes.
